Public Offer
This document is an official public offer by Uladzimir Takushevich, a self-employed individual — payer of professional income tax (Tax ID: CA7774946, Republic of Belarus, Vitebsk), hereinafter the "Provider", and sets out all essential terms for the provision of services through the website little-white.by.
1. General
Acceptance (full and unconditional) of this offer is the placement and payment of an order on the website. Upon acceptance, the agreement is concluded on the terms of this offer and the related documents: the Terms of Use, Refund Policy, and Privacy Policy.
2. Subject of the Offer
The Provider renders a service of granting access to self-developed software: the WhitePage CMS commercial license, WhitePage PRO modules and online services. Payment is payment for the service of granting access to the software (for a subscription — for the paid period) and does not constitute the sale of goods.
Installation, setup and maintenance of websites running WhitePage CMS are not part of this offer. The free version of WhitePage CMS is distributed under the Terms of Use and the license included in the distribution; downloading and using it is not a service under this offer.
Turnkey website development on WhitePage and website migration are carried out under a separate agreement with the Customer: the scope of work, timing, cost and post-launch support are determined by that agreement. Unless that agreement provides otherwise, maintenance of the website after delivery is not included, and Section 7 applies to the website.
The WhiteShield service includes installation, setup and maintenance of protection software on the server of the Customer under the terms of Section 8. The WhitePanel server control panel is provided free of charge together with WhiteShield under the terms of Section 9.
3. Price and Payment
The cost of services is stated on the website in Belarusian rubles (BYN). Payment is made using one of the following methods:
- by bank card via the bePaid service;
- by bank card via the WebPay system;
- via the ERIP ("Raschet") system using the express-pay service;
- via the YooKassa service (bank cards, YooMoney wallet and other methods enabled in YooKassa) — in Russian rubles at the rate shown on the website at the time the order is placed.
The payment procedure and payment security rules for each method are set out in Section 5 of the Terms of Use. A professional income tax (NPD) receipt is issued for every payment.
4. Service Delivery
The service is deemed rendered upon granting access: the license key and download link are shown in your account (Orders section) and sent to the authorized messenger. The delivery procedure is detailed on the Service Delivery page.
5. Refunds
The terms and procedure for refunds are set out in the Refund Policy.
6. Personal Data
By placing an order, the user confirms consent to the processing of personal data to the extent and on the terms set out in the Privacy Policy, in accordance with the Law of the Republic of Belarus "On Personal Data Protection".
7. Liability
7.1. The software of the Provider (WhitePage CMS, modules, themes, WhitePanel) is provided "as is". The Provider does not guarantee that the software will run without errors or interruptions, suit the purposes of the Customer, or work on the server and hosting chosen by the Customer.
7.2. No software is completely immune to attacks and vulnerabilities. The security measures in the software, its updates, and the answers and recommendations of the Provider are aimed at improving protection or are advisory, and do not constitute a guarantee of any result. The Provider makes efforts to improve the quality of the software and to fix discovered bugs and vulnerabilities in subsequent releases, but does not guarantee the absence of vulnerabilities or the time frame for fixing them.
7.3. The website of the Customer runs on a server and hosting chosen and maintained by the Customer. The Customer is solely responsible for:
- the operation and availability of the server, hosting, domain name and communication channels;
- keeping passwords and access keys safe and granting access to third parties;
- backups of the website and data;
- timely installation of software updates, including security updates;
- third-party modules, themes and code, as well as own changes to the code;
- the content of the website and the data processed on it.
7.4. The Provider is not liable for interruptions in the operation of the website or its failure to work, its hacking, infection, defacement, or loss, corruption or leakage of data, if they are caused by:
- actions of third parties, including attacks on the website or server;
- failures, maintenance or shutdown of the server, hosting, networks and third-party services (including payment services);
- incompatibility of the software with the server, hosting or their configuration;
- vulnerabilities in the software, including those unknown or not yet fixed at the time of an attack;
- the circumstances listed in clause 7.3 and other causes beyond the control of the Provider;
- force majeure.
7.5. The Provider does not compensate lost profits or indirect damages. The liability of the Provider for a paid service is limited to the amount the Customer paid for that service for the last paid period (for a subscription — for the last month). The Provider bears no liability for damages in respect of software provided free of charge.
7.6. The limitations of this section apply to the extent permitted by law and do not limit rights that the law expressly prohibits limiting (including consumer rights and liability for intentional breach).
8. Special Terms for WhiteShield
8.1. WhiteShield is a service of installing, setting up and maintaining protection software on the server of the Customer. The Provider does not lease servers, computing capacity or communication channels and is not a hosting provider.
8.2. All actions of the Provider within the service — setting up protection, updating its rules, recommendations and consultations — are aimed at improving the protection of the website or are advisory, and do not constitute a guarantee of any result. The Customer decides whether to follow the recommendations.
8.3. The Provider performs setup and maintenance in good faith and with reasonable care and, as part of maintenance, responds within a reasonable time to incidents that come to its attention.
8.4. Protection reduces the risk of attacks and unwanted traffic but does not guarantee that the website will not be attacked, hacked or unavailable, nor that all unwanted traffic will be blocked. The service is provided on a reasonable-efforts basis, without a guaranteed availability level.
8.5. The Provider is not liable for unavailability of the website caused by failures, maintenance or shutdown of the server of the Customer by the hosting provider; failures of the website itself; attacks exceeding the capacity of the server and channel of the Customer; actions of the Customer or persons the Customer has given access to.
8.6. The total liability of the Provider for the WhiteShield service is limited to the amount paid by the Customer for the last month of the service.
8.7. The Customer is the operator of personal data processed on the website of the Customer. When given technical access to the server, the Provider processes such data only on behalf of the Customer, to the extent necessary to render the service, and does not export it outside the server of the Customer.
8.8. If the website of the Customer is used to distribute content prohibited by law (including malware or phishing), the Provider may suspend the service with notice to the Customer.
9. Special Terms for WhitePanel
9.1. WhitePanel is a server control panel provided free of charge together with the WhiteShield service and installed on the server of the Customer. No fee is charged for WhitePanel; its installation and updates as part of WhiteShield maintenance are performed under the terms of Section 8.
9.2. WhitePanel is provided "as is"; clauses 7.1–7.4 apply to it. The Provider does not guarantee the compatibility of WhitePanel with the server, operating system and software of the Customer, nor the operation of websites hosted in it.
9.3. Actions in the panel (changing settings, deleting websites, databases and files, restoring from backups, updating software) are performed by the Customer or persons the Customer has given access to; the consequences of these actions are the responsibility of the Customer.
9.4. Backups created by WhitePanel do not replace the own backups of the Customer. The Provider does not guarantee that they are created, complete, or restorable.
9.5. As WhitePanel is provided free of charge, the Provider is not liable for damages related to its use, to the extent permitted by law.
